Sealed or electronic bids will be received until 10:00 a.m. (CST) on Friday, May 13, 2022, and then publicly opened and read at the Board Room in the Pontotoc County Chancery Building, 34 S Liberty St, Pontotoc, MS 38863 for furnishing all labor, materials and equipment and performing all work necessary for: LIGHTING IMPROVEMENTS PHASE 1. Sealed bids will be received until the designated date and time at Chancery building, Pontotoc, Mississippi.

Electronic bids will also be received until the designated date and time via electronic online bid
submission through www.esiplans.com. Project shall consist of construction of Solar Wind Cone, Rotating Beacon, Sandblast and Paint Existing Beacon Tower, New Electric Vault Equipment in Existing Electric Equipment Vault. Copies of the bid documents including project drawings and technical specifications are on file and may be inspected at:
Pontotoc County Chancery Building, 34 S Liberty St, Pontotoc, MS 38863 Contract Documents, including Drawings and Specifications, may be examined at the office of Engineering Solutions, Inc., located at 1324 N. Veterans Blvd., Tupelo, Mississippi, and also can be viewed and/or purchased at Engineering Solutions, Inc. plan room at www.esiplans.com. Deposit is non-refundable. Each proposal must be accompanied by a bid guaranty in the amount of five (5) percent of the
total amount of the bid. The bid guaranty may be by certified check or bid bond made payable to
PONTOTOC COUNTY. Bids may be held by the PONTOTOC COUNTY BOARD OF SUPERVISORS for a period not to exceed 60 days from the date of the bid opening for the purpose of evaluating bids prior to award of contract. This project is subject to the requirements of the Davis-Bacon Act, as amended. The Contractor is required to comply with wage and labor provisions and to pay minimum wages in accordance with the schedule of wage rates established by the United States Department of Labor. Award of contract is also subject to the following Federal provisions:

(a) Presidents Executive Order No. 11246 as amended by 29 CFR Part 30 and 41 CFR Part 60.

(b) Davis Bacon and Related Acts, 29 CFR Parts 1, 3, and 5.

© Copeland Act, 29 CFR Part 3.

(d) Contract Work Hours and Safety Standards Act.

(e) Title VI of Civil Rights Act of 1964.

(f) DOT Regulation 49 CFR PART 29 – Governmentwide Debarment and Suspension and
Governmentwide Requirements for Drug-free Workplace.

(g) DOT Regulation 49 CFR PART 30 – Denial of Public Works Contracts to Suppliers of
Goods and Services of Countries that Deny Contracts to Suppliers of Goods and Services of
Countries that Deny Procurement Market Access to U.S. Contractors (Foreign Trade Restriction).

(h) TITLE 49 United States Code, CHAPTER 501 – Buy American Preferences

The PONTOTOC COUNTY BOARD OF SUPERVISORS, in accordance with the provisions of
Title VI of the Civil Rights Act of 1964 (78 Stat. 252, 42 U.S.C. §§ 2000d to 2000d-4) and the
Regulations, hereby notifies all bidders that it will affirmatively ensure that any contract entered
into pursuant to this advertisement, disadvantaged business enterprises will be afforded full and
fair opportunity to submit bids in response to this invitation and will not be discriminated against
on the grounds of race, color, or national origin in consideration for an award.

By submitting a bid/proposal under this solicitation, the bidder or offeror certifies that at the time
the bidder or offeror submits its proposal that neither it nor its principals are presently debarred
or suspended by any Federal department or agency from participation in this transaction.

The PONTOTOC COUNTY BOARD OF SUPERVISORS reserves the right to waive any informalities or irregularities in the bids received and to reject any or all bids or to award or refrain from awarding the contract for the work, whichever is deemed to be in the Owner’s best interests.
